“Elon Musk vs. Sam Altman: Billionaire Legal Battle over OpenAI’s Future”

Two billionaires are locked in a legal battle that has stirred up discussions about the future of humanity.

Elon Musk, currently the wealthiest person globally, has accused Sam Altman, the CEO of OpenAI, of appropriating a “charitable” organization and is demanding his removal from the company’s leadership.

Recently, closing arguments concluded in Oakland, California, and a jury will soon deliberate, with U.S. District Judge Yvonne Gonzalez Rogers set to make the final ruling. The case alleges that OpenAI violated its founding agreement by transitioning into a for-profit entity, with Musk seeking $150 billion in damages.

Ebrahim Bagheri, a specialist in responsible AI development at the University of Toronto, highlights the substantial impact the court’s decision will have on the AI sector. He notes that when OpenAI was established, the potential of generative AI technology to become highly potent and profitable was not entirely foreseeable.

“If there’s a restructuring within OpenAI, it will not only affect the services of OpenAI but also impact numerous other companies, including major players like Microsoft,” Bagheri remarked.

Several prominent figures from Silicon Valley have testified during the trial, while demonstrators outside the courthouse have directed their grievances towards both sides.

Catherine Bracy, the CEO of TechEquity, an organization focused on tech industry inequality, believes that to onlookers of the trial, it might appear that all parties involved are losing in the public eye.

As the jury prepares to deliberate, here is the current status of the case.

‘The fate of civilization’

Established as a non-profit in 2015 by Musk, Altman, and others, OpenAI has transformed into a for-profit entity that is expected to go public with a valuation of $1 trillion. Musk aims to revert OpenAI back to a non-profit status and remove its president, Greg Brockman, who holds a $30 billion stake in the company.

Musk accuses OpenAI of coercing him into providing $38 million and accepting substantial investments from Microsoft and other firms. He is pursuing approximately $150 billion in damages from both OpenAI and Microsoft, intending for the funds to be directed to OpenAI’s non-profit division.

An email exchange from February 2023 that emerged as evidence prior to the trial underscored a significant rift between Musk and Altman.

After expressing admiration for Musk, Altman stated, “I don’t believe OpenAI would have come to fruition without you — and it deeply pains me when you publicly criticize OpenAI.”

In response, Musk acknowledged, “I understand your sentiments, and I do not intend to cause harm, for which I apologize, but the future of civilization is at stake.”

In another message exchange with Brockman proposing a potential settlement, Musk cautioned that the trial could potentially result in Brockman and Altman becoming widely reviled.

Musk’s motives have been questioned, given that his for-profit AI company, xAI, is considering an initial public offering as part of SpaceX, suggesting a financial incentive to eliminate a competitor.
