Quebec Doctors Challenge Premier’s Bill in Court

Quebec’s medical specialists and family doctors federations are planning to challenge Premier François Legault’s bill in court. The legislation, which was passed into law early Saturday despite opposition, aims to change doctors’ compensation and put an end to their pressure tactics. The Fédération des médecins spécialistes du Québec (FMSQ) and the Fédération des médecins omnipracticiens du Québec (FMOQ) have initiated legal proceedings against the government.

The bill, named Act 2, focuses on improving access to medical services and ensuring their continuity. It mirrors the principles outlined in Bill 106 from May, which includes tying doctors’ pay to performance indicators to manage heavier patient loads. This action follows the province’s fourth offer during stalled negotiations with doctors who have been without a contract since 2023.

Health Minister Christian Dubé defended the legislation, emphasizing the necessity to ensure Quebecers receive proper healthcare. Dubé stated that the current health care system is unsustainable, requiring changes to guarantee efficient care delivery.

The Coalition Avenir Québec (CAQ) government asserts that the bill aims to address the lack of family doctors for 1.5 million Quebecers, especially vulnerable patients. The proposed legislation mandates assigning every eligible Quebecer to a family medicine group. A portion of doctors’ salaries will be tied to performance metrics, with additional incentives for achieving specific targets related to service access and quality.

Furthermore, the bill includes measures to curb pressure tactics by doctors and their representatives, imposing penalties for coordinated actions affecting medical training. Despite concerns raised by medical professionals, the government insists that the bill is necessary for the welfare of patients.
