“Hamilton Police Officer Acquitted of Sexual Assault Charges”

Jeffery Turnbull has been acquitted of charges related to an alleged sexual assault on a fellow Hamilton police officer in 2022 after a trial that commenced in January. Ontario Justice Jennifer Marie Campitelli delivered the verdict in Burlington, stating that she found the complainant’s testimony not credible while believing Turnbull.

During the legal proceedings, Crown lawyer Jason Nicol contended that Turnbull had engaged in inappropriate behavior towards the younger officer, including making sexual remarks, sending unsolicited messages and gifts, and touching her without consent before the alleged assault in March 2022.

The complainant testified that Turnbull persistently communicated with her, gave her gifts, flirted with her, and even threatened suicide to coerce her compliance. She claimed that Turnbull sexually assaulted her at his residence despite her objections.

The defense countered by suggesting that the two had a consensual relationship, presenting text messages as evidence of a friendly interaction. Turnbull maintained that the encounter was consensual and that the woman willingly participated.

Justice Campitelli summarized the arguments presented by both sides, highlighting discrepancies in the complainant’s statements and evidence inconsistencies. She found Turnbull’s testimony credible and aligned with independent evidence, while questioning the honesty and reliability of the woman’s account.

Ultimately, Campitelli ruled in favor of Turnbull, stating that the Crown failed to prove beyond a reasonable doubt that the sexual conduct was non-consensual. Turnbull, who remains suspended with pay pending further actions, may potentially return to his position with the Hamilton Police Service.

The legal process, spanning over 3½ years, was described as challenging for both parties involved. The Hamilton Police Association reiterated its support for the individuals and emphasized the need for ongoing assistance throughout the next steps in the case.
