The International Court of Justice (ICJ) has ruled that Israel must permit the United Nations Relief and Works Agency for Palestine Refugees (UNRWA) to deliver humanitarian aid to Gaza. The UN General Assembly sought the court’s opinion after Israel prohibited the UN agency, which plays a key role in aiding Gaza, from operating in the region.
According to the ICJ President, Yuji Iwasawa, Israel is obligated to support relief efforts by the United Nations and its entities, including UNRWA. Despite Israel’s absence from the April hearings, where it was accused of breaching international law, the country submitted a 38-page written statement for consideration.
Advisory opinions from the ICJ hold significant legal weight and could impact UN operations globally. Israel has dismissed the court’s findings, calling them biased, and emphasized its adherence to international law.
Israel’s rejection of the ICJ’s advisory opinion has sparked controversy, with the Israeli ambassador to the UN, Danny Danon, condemning the decision as “shameful.” Danon criticized UN organs for alleged ties to terrorist groups like Hamas, particularly singling out UNRWA.
The fragile ceasefire in Gaza, brokered by the US and effective since October 10, has faced challenges following recent deadly clashes. Despite ongoing tensions, aid trucks are permitted to enter Gaza daily under the ceasefire terms.
The ban on UNRWA by Israel, implemented in January, has drawn criticism from Prime Minister Benjamin Netanyahu and his allies, who claim the agency has Hamas affiliations. Canada briefly suspended funding for UNRWA based on similar concerns raised by Israel, which were later refuted by a UN investigation report.
Israel’s actions, including a temporary halt on aid shipments and accusations against Hamas, have led to food shortages and humanitarian crises in Gaza. The country’s decision to shift aid distribution to a US-backed organization faced backlash, worsening conditions in the region.
While advisory opinions from the ICJ are non-binding, they hold weight in resolving disputes involving UN personnel. Israel’s stance on UN operations has been contentious, with past rulings challenging its policies in occupied territories.
