“Ostrich Farm Creditors Seek CFIA Help Amid Legal Battle”

Creditors of a prominent ostrich farm in southeastern British Columbia are seeking assistance from the Canada Food Inspection Agency (CFIA) to recover substantial debts following a legal battle. The CFIA is considering the destruction of over 300 birds owned by Universal Ostrich Farms Inc. due to the presence of avian flu among some of the animals since December.

The farm, located in Edgewood, B.C., has faced challenges meeting financial obligations, with creditors claiming that the farm owners have disregarded court orders to repay debts exceeding $250,000. In an attempt to secure compensation in case the Supreme Court of Canada permits the cull, creditors have taken steps to garnish the CFIA funds intended for the ostrich farm.

Legal proceedings against Universal Ostrich Farms have shed light on its financial troubles, which the farm owners maintain are separate from the legal dispute over the fate of the ostriches. The farm has solicited public donations to support its legal battle and ongoing operations during the quarantine period.

One creditor, represented by lawyer Steven Cope, obtained a judgment against Universal Ostrich last year. The farm owners emphasize that their focus remains on safeguarding the ostriches and fulfilling their legal obligations amid the ongoing legal challenges.

The CFIA’s decision on the destruction order is pending, as the farm continues to operate under the quarantine measures. The farm’s financial history has become a significant aspect of the legal proceedings, with arguments centered on the potential economic impact of the cull on the business.

Creditors have pursued legal action to recover outstanding debts, including one creditor planning to serve a garnishing order on the CFIA regarding a judgment against the farm. Despite the uncertainties surrounding the financial situation, efforts to resolve the debt issues are ongoing while awaiting further court decisions and CFIA actions.

As the legal battle unfolds, the fate of Universal Ostrich Farms and its ostriches remains uncertain, with creditors seeking to secure their dues amidst the complex financial and legal challenges facing the farm.
