“Harvey Weinstein’s Rape Retrial Ends in Mistrial”

The rape retrial of Harvey Weinstein concluded in a mistrial on Friday after the jury failed to reach a unanimous verdict, mirroring the outcome of a previous trial. While Weinstein has been convicted of other sex offenses and is currently incarcerated, the New York rape charge remains unresolved after three trials. Weinstein, once a powerful figure in Hollywood, showed no emotion as he was wheeled out of the courtroom.

The Manhattan jury, predominantly male, deliberated on whether Weinstein raped Jessica Mann, a hairstylist and actor, in 2013. Weinstein’s defense team claimed the encounter was consensual, occurring during a tumultuous relationship between Weinstein and Mann. Signs of a deadlock emerged during deliberations when jurors indicated they could not reach a unanimous decision. Despite instructions from Judge Curtis Farber to continue deliberating, the jury remained deadlocked.

One juror revealed that nine members wanted to acquit Weinstein, while three sought a conviction. Defense attorney Marc Agnifilo hailed the outcome as a victory for the jury system. A hearing is scheduled for June 24 to determine if prosecutors will pursue a fourth trial. District Attorney Alvin Bragg expressed disappointment but emphasized respect for the jury’s decision and mentioned consultation with Mann regarding further legal proceedings.

Weinstein’s downfall began in 2017 when sexual misconduct allegations surfaced, leading to criminal charges in New York and Los Angeles. Despite convictions and acquittals, Mann’s accusation persisted. Mann, who met Weinstein in 2013, testified about the alleged rape years later, detailing her experience of being blocked from leaving and ultimately assaulted by Weinstein.

Mann’s delayed disclosure of the incident raised questions during the trial, with Weinstein’s defense portraying their relationship as consensual and supportive. Mann’s interactions with Weinstein post-incident were scrutinized, revealing a complex dynamic. Only after seeing reports about Weinstein’s misconduct did Mann decide to report the assault to the authorities.

Mann did not pursue legal action against Weinstein but received compensation from a sexual misconduct settlement fund. The defense did not address this payment during the recent trial. Mann’s willingness to be identified contrasts with the usual anonymity afforded to sexual assault survivors.
