“Setback for Advocates as Alberta Court Upholds Transgender Youth Medical Restrictions”

Advocates supporting transgender youth in Alberta have faced a setback in their legal battle against provincial limitations on medical care. Egale and Skipping Stone sought permission from a judge to argue that Premier Danielle Smith’s government exceeded its authority with the legislation. In response to the restrictions on medical treatments for transgender youth, the advocacy groups contended that the issue falls under federal jurisdiction due to potential fines or imprisonment for doctors not adhering to the new regulations.

However, Justice Allison Kuntz of the Court of King’s Bench ruled in favor of the Alberta government, stating that the legislation pertains to health and safety, falling within the province’s constitutional mandate. Egale and Skipping Stone expressed their intention to appeal the decision, emphasizing the impact on transgender and gender-diverse young individuals who are deprived of essential medical care due to the legislation.

The legal dispute traces back to 2024 when Smith’s government introduced laws affecting transgender individuals, including a prohibition on certain medical treatments for those under 16. The advocacy groups challenged the legislation on behalf of families with transgender youth, citing concerns about the adverse effects on gender-diverse individuals. Despite winning a temporary injunction against the health restriction in June 2025, the government later invoked the notwithstanding clause to override certain Charter rights, leading to the dismissal of the injunction.

The ongoing legal battle highlights the clash between provincial legislation and Charter rights, with similar cases unfolding in other provinces like Saskatchewan. The Supreme Court of Canada is set to weigh in on these matters, including the use of the notwithstanding clause in challenging laws affecting transgender rights. Alberta’s legislation targeting transgender individuals remains contentious, with implications for the broader legal landscape and the rights of gender-diverse individuals.
